Terms of Service

1. The service

LotHours provides workforce management software for car dealerships including time tracking, internal messaging, and customer SMS via dealership-owned phone numbers ("the service").

2. Accounts

You must provide accurate information and keep credentials secure. You're responsible for activity under your account. You must be at least 18 to create an org account.

3. Subscription and payment

Pro and Enterprise plans are billed per site. The 14-day Pro trial does not require payment. After the trial, your subscription auto-renews monthly until canceled. Cancel anytime from the billing portal — you keep access until the period ends.

4. Customer SMS responsibilities

When using customer SMS via dealership-owned numbers you must comply with TCPA, CAN-SPAM, and applicable state laws including A2P 10DLC registration. You represent that you have prior express consent before sending marketing messages, and you'll honor opt-out requests promptly.

5. Acceptable use

No illegal use. No reverse engineering, scraping, or attempting to circumvent access controls. No use that disrupts other customers.

6. Data ownership

Your dealership owns its data. We act as a processor. You can export data anytime; we'll delete it within 30 days of account closure (subject to retention requirements in our Privacy Policy).

7. Mobile apps

The LotHours mobile apps are licensed, not sold. The license is non-exclusive and revocable. App Store and Google Play terms apply to your install.

8. Service availability

We strive for 99.9% uptime but make no guarantee. Scheduled maintenance announced when feasible.

9. Disclaimer and limitation

The service is provided "as is" without warranties. To the fullest extent permitted by law, our liability is capped at the fees you paid us in the 12 months preceding any claim.

10. Termination

Either side can terminate for material breach with 30 days' notice. We can terminate immediately for non-payment or violation of acceptable use.

11. Governing law

State of California, USA. Disputes resolved in San Diego County.
